Notarial deeds for Hungarian rentals: protection, fees and tax costs

A properly drafted notarial deed can clarify commitments and help enforce them. Its effect depends on the obligations it records: signature certification, a move-out undertaking and a full notarial lease are different instruments.

Hungarian scope: useful protection, not a universal formality

This edition concerns long-term residential letting in Hungary; the tax section assumes a private individual outside a sole-trader business. General information, not individual legal or tax advice. A residential lease must be in writing; a notarial form is not a universal validity requirement for every private lease. The parties may agree in advance to obtain an appropriate deed.

  • Keep the agreement, inventory, condition evidence and payment records too. A notary is impartial, and both sides need to understand the commitments.

Three documents with different effects

Check the content and legal effect rather than the name of the document.

  • Signature certification establishes who signed or acknowledged a signature; it does not by itself make every lease obligation directly enforceable.
  • A move-out undertaking is the tenant’s unilateral commitment in a notarial deed. If it covers only vacating, it does not automatically cover rent arrears or every damage claim.
  • A notarial lease or broader undertaking can also record sufficiently defined payment obligations. The actual wording determines its scope.

Why direct enforceability matters

Under section 23/C of Hungary’s Enforcement Act, a qualifying notarial deed can receive an enforcement clause for a due, enforceable obligation without a separate judgment ordering performance. An application and enforcement process still remain.

  • The creditor, debtor, obligation, legal basis, amount or quantity, method and deadline must be properly identified.
  • If performance depends on a condition or event in time, its occurrence must also be certified in a public document as required by law. Check termination and service evidence with the notary.
  • An estimated, disputed repair bill does not automatically become an enforceable debt merely because a move-out deed exists.

How preparation works

Agree the intended protection before finalising the lease: vacating, payment or both. Ask the notary to review the chosen structure and required documents in advance.

  • Agree the deed type, completion deadline and cost allocation.
  • Provide the draft or signed lease and accurate commitments securely; check identification, attendance, representation and interpreting needs.
  • The notary checks requirements and explains the contents and consequences. Sign only understood, genuine commitments.
  • Retain the proper copies and associated lease; review coverage after amendments.

What happens if the tenant does not perform?

Identify the due obligation and correctly make and evidence any required notice or termination. The notary decides on ordering enforcement on the appropriate application; a bailiff carries it out.

  • The deed does not authorise changing locks, removing belongings or cutting utilities to force departure.
  • Applicable eviction restrictions, winter moratorium and remedies can affect timing. There is no guaranteed payment or eviction date.
  • Enforceability does not guarantee solvency. Assess additional enforcement costs and actual recovery prospects.

Who pays? Agree this in advance

Between themselves, landlord and tenant can agree that either party pays all of the fee or that they share it. Record payment, reimbursement and deadlines in writing. It is not automatically the tenant’s expense.

  • Liability towards the notary is separate: under the Hungarian fee regulation the applicant pays in an application-based procedure; multiple parties are jointly and severally liable. Their internal agreement does not override that liability.
  • Obtain an advance fee estimate for the specific deed and copies under the statutory tariff. Later enforcement has its own costs.
  • If sharing, identify who advances the fee, who reimburses whom and which records prove the transfers.

Can a Hungarian landlord deduct the fee?

With itemised expenses, a directly rental-related, actually incurred and paid, properly evidenced allowable cost may be deducted within statutory limits. Applying this general rule, an appropriate lease-related notarial fee may qualify; check the particular document and who bears it.

  • The 10% expense-allowance method permits no additional separate deduction of this fee. Recording an expense does not establish deductibility.
  • A fee paid directly by the tenant is not automatically the landlord’s own expense. For sharing or reimbursement retain the agreement and payment evidence and examine the tax treatment of money received too.
  • Illustration, not a fee quote: a wholly landlord-borne 60,000 HUF fee, assumed fully deductible, reduces the tax base by 60,000 HUF. With sufficient taxable income and 15% personal income tax, the difference is 9,000 HUF, not a 60,000 HUF tax refund.
  • Keep the invoice or appropriate cost document, payment proof and rental connection together. Business or cross-border tax situations need separate assessment.

Do other countries have comparable arrangements?

France’s bail notarié can support enforcement of rent payments, but eviction still needs judicial proceedings. Do not assume an equivalent Hungarian move-out route in the Netherlands: disputed termination and eviction follow Dutch tenancy protections and court rules.

  • Check the country, location and obligation. A notary’s involvement does not establish identical legal effects or tax treatment across borders.

Frequently asked questions

Must the tenant always pay the notary?

No. Agree the internal allocation, while checking statutory liability towards the notary separately.

Does a move-out deed automatically cover arrears?

Only adequately defined payment obligations covered by the appropriate deed can benefit, subject to the other enforcement requirements.
